SOLIDARITY Editor Martin Wicks examines the implications of two recent injunctions against strike action by UNITE and the RMT. This is a SOLIDARITY discussion bulletin which can be downloaded from http://solidaritymagazine.wordpress.com

The recent injunctions issued against strike action by UNITE and the RMT have grave implications for the whole trade union movement. They place a question mark over the right to strike. There were two main parts to these judgements: ‘irregularities’ in the balloting process and a new concept of ‘proportionality’ (which has no precedent in UK law) based on European Union law and judgements by the European Court of Justice (ECJ) relating to the Laval and Viking cases.

What you have to do from now on is make sure your votes are 100% correct the last two one was poorly done with BA and the other was technicality, shows how the courts will go with the business, not the people.

Just an observation: on the continent, people are striking, calling strikes across sectors, unions united and they are marching, protesting, standing for their rights…. England? Where is everybody?
On 24th of June the French were streaming .. and I mean STREAMING across France in all towns and cities… Their turnaround for organising this protest was phenomenal, very short notice. We should be doing exactly the same! Right now! Where are the Unions!? Come on .. the LRC, you should be leading the march with others together… Even the French manage to get together across their (otherwise) factional differences, The French Communist Party marching, The Socialist Party, marching, the CGT, CFDT, CFTC and more… all there.. people from all walks of life, unaffiliated, unionised or not, member of a party of not…. What is it about England?

Should have added… European Law applies to all EU countries. So why is it becoming such a greater issue here than it does with actions taken on the continent?

Yes but we had our battles with the miners strike and we had other major strikes through out this last forty fifty years, people who were once labour activist from major Unions were all kicked out of the Labour Party, what you have now is a New labour Party which is full blown Thatcherite.

The last company I worked for before my accident had a meeting about a strike, the meeting was called and nobody turned up, they refused to strike, six months later the factory closed with the loss of 450 job, one women said we should have gone on strike, it was to late.

People no longer march for wars or anything people in the UK have been beaten by the Tories and new labour.

Well People, with no offense, if you will not make a stand, prepare to lose all….. I know you had your battles with the miners’ strikes… but the Pheonix rises out of the ashes… and so it should be… into a new era.. when history calls…. because this… is something else than the Thatcher years… this is going potentially much worse. Forget about New Labour… ‘new’ ... neo-liberals. This is what needs to be brought down. There is no other way but forward. It might be necessary to cut off from the ‘new labour’ section of the party. That is something to consider, and rethink the politics and policies, looking forward…. and a lot of ground work needs to be done, outreach.. to people all over the country. The campaign has to start NOW.
